The Investigating Directorate Against Corruption (IDAC) has approached the Pretoria High Court to review a magistrate’s decision to recuse himself.
The case involves Lieutenant-General Dumisani Khumalo and two other senior police officials.
The magistrate cited allegations of judicial corruption raised at the Madlanga Commission as the reason for stepping aside. IDAC argues these allegations have no bearing on the matter before the court.
IDAC spokesperson Henry Mamothame said the directorate does not agree with the recusal.
“The IDAC is of the view that the presiding magistrate should not have recused himself from the matter, as allegations made at the Madlanga Commission have no bearing on the matter before court,” Mamothame said.
The matter has been postponed to November 6 2025 for the court to rule on the review application.
Khumalo, together with Major General Josias Lekalakala and Major General Nosipho Madondo, has applied to have his bail conditions relaxed.
The three were arrested with four others on charges of fraud and corruption.
The charges relate to the appointment of an unqualified civilian within the South African Police Service’s Crime Intelligence Division.
The State is opposing the bail application, which will only be heard after the court’s decision on IDAC’s review, said Mamothame.
