A Northern Cape tax consultant found guilty of defrauding the South African Revenue Services (SARS) has been sentenced to pay a fine of R100,000 or spend four years in jail.
Jason Puso Ndlovu, 35, was sentenced this week in the Kimberley Serious Commercial Crimes Court.
Explaining the merits of the case, the Directorate for Priority Crimes Investigation (known as Hawks) said that during the tax periods of 2016 and 2017, Ndlovu, as a tax consultant, assisted Mohayi & Associates Pty Ltd to submit tax returns.
“He made a misrepresentation to the SARS by submitting R1.00 Corporate Income Tax Returns for the 2016 period and nil Corporate Income Tax Returns for the 2017 period,” said Hawks spokesperson Warrant Officer Nomthandazo Mnisi.
Mnisi further stated that the fraudulent returns submitted by the accused resulted in SARS suffering potential prejudice estimated at R1,400,000.
Ndlovu was arrested and charged with tax evasion on 07 March 2023 and made his first appearance in court on 05 May 2023.
The Provincial Head of the Directorate for Priority Crime Investigations, Major General Steven Mabuela, congratulated the investigating and prosecution team for their sterling work.
