The criminal case against Crime Intelligence boss Lieutenant-General Dumisani Khumalo, Brigadier Dineo Mokwele and their co-accused has been dropped after they were wrongfully charged by the Investigating Directorate Against Corruption (IDAC).
The National Prosecuting Authority has withdrawn the fraud and corruption charges linked to Mokwele’s appointment to a senior Crime Intelligence position, bringing an extraordinary turn to a case that placed some of the country’s most senior police officials under criminal scrutiny.
The Pretoria Magistrate’s Court ruled that the case has been dropped. “You are free to go,” the court said.
Khumalo and seven other officials were arrested by the Investigating Directorate Against Corruption in June 2025.
The prosecution alleged that Mokwele’s appointment was irregular and that officials had circumvented required processes, including vetting and security-clearance procedures.
Allegations also concerned her qualifications and the handling of sensitive intelligence resources.
Those allegations have since come under intense examination at the Madlanga Commission.
The inquiry heard evidence from senior prosecutors and investigators that raised serious questions about how the case was assembled and whether investigators moved ahead before the evidence was sufficiently developed.
Senior IDAC prosecutor Advocate Peter Serunye testified that the investigation proceeded on allegations rather than adequate evidence and said the case had made little sense to him.
He also told the commission that evidence presented during the hearings had fundamentally changed his understanding of the matter.
Former IDAC head Advocate Andrea Johnson’s role has also come under sustained scrutiny. The commission heard allegations about pressure within the directorate and disagreements over the strength and direction of the investigation.
The controversy has fuelled broader questions about whether the criminal case formed part of a wider struggle inside South Africa’s law-enforcement structures.
Khumalo’s arrest became particularly significant after KwaZulu-Natal Police Commissioner Lieutenant-General Nhlanhla Mkhwanazi publicly raised allegations of political interference, organised crime and attempts to disrupt sensitive police investigations.
The Madlanga Commission is examining those wider allegations, including claims concerning the Political Killings Task Team and investigations into powerful criminal networks.
