Khan’s lawyers warn Madlanga Commission medical exam could worsen his condition

Lawyers for hospitalised Crime Intelligence deputy Feroz Khan have warned that an independent medical examination ordered by the Madlanga Commission could further harm their client.

Appearing before the commission on Tuesday, Khan’s legal team firmly opposed the proposed examination, arguing that subjecting the injured deputy to another medical assessment could put his recovery at risk.

“This could worsen his conditions,” his lawyer, Muhammed Vally said.

The warning came after evidence leader Advocate Adila Hassim proposed that the inquiry appoint an independent medical examiner to establish Khan’s current condition and determine whether he is fit to testify.

Khan was subpoenaed to appear before the commission to answer allegations concerning criminality within the justice system.

He has, however, repeatedly been unable to testify after suffering gunshot wounds allegedly sustained outside his Johannesburg home in June.

He was expected to take the stand on Tuesday, but the commission was informed that he had been readmitted to hospital.

In his continued absence, the inquiry has examined WhatsApp messages allegedly linking Khan to political and business figures, multimillion-rand property and vehicle holdings, and suspected tender fraud.

The commission has also heard about an alleged personal relationship between Khan and the former head of Investigating Directorate Against Corruption (IDAC), Advocate Andrea Johnson.

Messages allegedly indicate that Johnson shared sensitive police information with Khan.

The commission is underway.
