Testify or be subjected to medical examination: Madlanga sets September 28 deadline

Madlanga Commission has postponed the testimony of Crime Intelligence deputy Feroz Khan to September 28 after failing to attend Tuesday’s proceedings because of his latest hospitalisation.

Commission chair Justice Mbuyiseli Madlanga postponed Khan’s testimony after his lawyers appeared on his behalf and requested more time.

They also opposed the possible appointment of an independent medical examiner.

But Madlanga imposed strict conditions on any further absence.

Khan will only be excused from appearing on September 28 if he undergoes an independent medical assessment by September 8.

The specialist must be agreed on by Khan’s representatives and the commission’s evidence leaders.

The resulting medical report must be submitted by September 15 to confirm that Khan is medically unable to testify.

If the parties fail to agree on a specialist, an independent medical professional will be nominated by the chairperson of the South African Society of Psychiatrists.

Madlanga also ordered Khan to submit his outstanding sworn statement by September 2026.

The chairperson said Khan’s diagnosed conditions may be disclosed publicly, but detailed information about his clinical symptoms, treatment and family circumstances must remain confidential.

Khan was re-admitted to the hospital over the weekend, shortly before his scheduled appearance.

The commission stressed that his subpoena remains legally valid despite his hospitalisation.
